The NAFE-L Emailing List, owned by a group of forensic economists, provides a forum for forensic economists and members of the National Association of Forensic Economics to exchange ideas, information, and new developments in the field of Forensic Economics. The members can share information by sending electronic mail to the mailing list. A copy of each message sent to the list is automatically sent to every subscribed member. An e-mail account is required for subscription and the Terms of Service (see below) must be accepted.

Any mail addressed to this list will be distributed to each member in the group, therefore it is advisable to use this service as a forum for discussion of the subject matter of forensic economics.

Each subscriber must comply with the Terms of Service. The NAFE-L email discussion list provides a forum for
NAFE members to advance the practice of forensic economics by exchanging ideas, resources, case law, and

configure their own email accounts so that NAFE-L messages are funneled into a unique folder, and a digest

By being a subscriber and user of the NAFE-L list, you expressly understand and agree that NAFE shall not be
liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited
to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if NAFE has been advised
of the possibility of such damages) resulting from: (a) the use or the inability to use the Service; (b) the cost of
procurement of substitute goods or services purchased or obtained or messages received or transactions
entered into through or from the Service; (c) unauthorized access to or alteration of your transmissions or data;
(d) statements or conduct of any third party on the Service; or (e) any other matter relating to the Service.

ACCEPTANCE OF TERMS
Welcome to NAFE-L. The National Association of Forensic Economics Board of Directors (“the Owner”)
provides this Service to you, subject to the following Terms of Service (“TOS”), which may be updated by us
from time to time without prior notice to you but with contemporaneous notice sent via NAFE-L. You can review
the most current version of the TOS at any time by clicking here . Your registration and continued use of
NAFE-L constitute your acceptance of these terms.
DESCRIPTION OF SERVICE
NAFE-L currently provides a forum for NAFE members to advance the practice of forensic economics by
exchanging ideas, resources, case law, and experience among both seasoned and newer practitioners (the
“Service”). Messages and questions are sent via email, with a copy of each message delivered automatically
to each list subscriber in real time. Unless explicitly stated otherwise, any new features that augment or
enhance the current Service shall be subject to the TOS. You understand and agree that the Service is
provided “AS-IS” and that the Owner assumes no responsibility for the timeliness, deletion, missed delivery, or
failure to store any user communications or personalization settings. In order to use the Service, you must be a
NAFE member (which includes accepting the Statement of Ethical Principles and Principles of Professional
Practice [ SEPPPP ], request this Service, and accept the TOS. In addition, you must provide all equipment
necessary to make such a connection to the NAFE-L, including a computer or other electronic device, internet
access, and a working email account unique to you.
YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current, and complete
information about yourself (“Registration Data”) as prompted by NAFE-L’s registration form and (b) maintain
and promptly update the Registration Data to keep it true, accurate, current, and complete.
SUBSCRIBER CONDUCT
You understand that all messages sent to NAFE-L are the sole responsibility of the person from which such
content originated. This means that you, and not the Owner or Managers, are entirely responsible for all
content that you post via the Service. The Owner does not control the content posted via the Service and, as
such, does not guarantee the accuracy, integrity or quality of such content. Under no circumstances will the
Owner be liable in any way for any content, including, but not limited to, any errors or omissions in any content,
or any loss or damage of any kind incurred as a result of the use of any content found on the Service.
You agree NOT to knowingly use the Service to:
a. Post any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar,
obscene, libelous, invasive of another’s privacy, hateful, or racially or ethnically objectionable;
b. Post any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,”
“pyramid schemes,” or any other form of solicitation, unless authorized specifically by the NAFE-L Managers;
c. Post any material that contains software viruses or any other computer code, files, or programs designed to
interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications
equipment;
d. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any
requirements, procedures, policies, or regulations of networks connected to the Service;
e. Collect or store personal data about other subscribers;
f. You acknowledge that the Owner does not pre-screen content, but that the Owner and Managers shall have
the right (but not the obligation) in their sole discretion to refuse or to remove any content that violates the TOS
or is otherwise objectionable. You agree that you must evaluate and bear all risks associated with the use of
any content, including any reliance on the accuracy, completeness, or usefulness of such content. In this
regard, you acknowledge that you rely on any content at your own risk. NAFE-L content in no way constitutes
legal advice.
USAGE PROTOCOLS
In order to foster active, relevant participation, welcome new voices, and maintain the utility of NAFE-L as a
valuable professional development tool, subscribers agree to follow these protocols. Questions about the
protocols should be addressed to one or more of the NAFE-L Managers listed at the bottom of this webpage.
a. Initiate discussion subjects which are directly relevant to forensic economics. Forensic economics is
the scientific discipline that applies economic theories and methods to matters within a legal framework.
Forensic economics encompasses, but is not limited to: calculation of pecuniary damages in personal,
commercial, and other litigation and discussion of legal standards relevant thereto; the analysis of civil liability,
such as the statistical analysis of discrimination; and other matters subject to legal review, such as public policy
analysis and business, property, and asset valuation. Although potentially virtually any topic could become
relevant in a legal dispute, NAFE-L subscribers composing an email message should consider the direct
relevance of the message to forensic economics. For example, messages not focusing on forensic economics
but instead focusing on macro indicators not commonly used in forensic economics (e.g., stock market
performance, inflationary trends) are of more general interest and therefore do not belong on NAFE-L unless
necessary to a response. If a subscriber desires information about a certain industry, for example the real
estate industry, they can post an inquiry. But a subscriber should not initiate a thread about real estate (even
though well-intentioned, since another subscriber may have a future case involving real estate); of course an
exception to this would be if the initial message concerns forensic economics directly since it provides case
law, or a link to an article concerning real estate damages , or discusses how a practitioner handled a certain
real estate issue in the context of a case. Messages regarding NAFE the organization or the NAFE-L itself are
indeed related to FE, but often are more appropriately addressed to the NAFE Executive Director or one of the
NAFE-L Managers. See “Not FE” (below) pertaining to weekend messages regarding subjects outside of
forensic economics.
b. Use specific, meaningful subject lines. This enables readers to scan incoming NAFE-L emails quickly
and also helps those using the NAFE-L archives. For example, rather than composing the subject line
“Seeking Advice,” use “Framing my analysis when the plaintiff supported non-adopted children?” Rather than
“Lost profits question,” use “Determining damage period for corp. seeking lost profits.” Rather than “Question
about Minnesota law,” use “Appropriate discounting methods in Minnesota?” Likewise, messages regarding
case law should be prefaced with a subject line summarizing the issue the court addressed (e.g., admissibility
or discounting). Why is the case notable? For example, rather than composing a subject line like “Rodriguez v.
Bethlehem Steel (1974) 12 Cal.3d 382,” use “Calif’s Rodriguez v. Bethlehem Steel (1974) & valuing spouse’s
care.” And when citing case law in the body of your message, it is most helpful to your fellow subscribers to
include a full reporter citation (and link) when possible, since many users do not have LEXIS access.
c. Users may change the subject line when a discussion thread’s subject evolves. For example, the
initial subject line might have been “25% discount offer for Harry/Kinrich Lost Profits book,” but then the
discussion turned toward invoicing clients for books and other research materials. Anyone on the thread could
change the subject for their message to “Billing clients for research materials.”
d. Usually NAFE-L should not be the first place you seek information. You can often get better NAFE-L
responses and show respect for the time of your fellow subscribers by informing yourself before posting an
inquiry, such as by reviewing the “State Series” of the Journal of Forensic Economics, or by searching online
(e.g., via Google Scholar).
e. Refrain from providing specific information from active cases , even if you believe that no other NAFE-L
subscriber is involved in the case. If case facts are necessary to the meaning of your NAFE-L message, then
take care to anonymize when composing your message.
f. Do not share posted messages outside NAFE-L, unless you have obtained permission from the
message’s originator(s). This includes not citing NAFE-L content in a deposition or any other legal context, or
sharing content with any persons who are not NAFE-L subscribers. This helps to facilitate open, uninhibited
discussion and is consistent with the NAFE Ethics Statement . Before sharing NAFE-L content you
must verify that the recipient is a NAFE-L subscriber and thus is bound by the TOS.
g. Choose whether to email an individual, rather than sending your message to the entire NAFE-L
group. Consider the likelihood of your message providing value to other NAFE-L subscribers. Some messages
and queries are best addressed to individual list members. For example, if you want to know about your NAFE
conference registration, or when the NAFE Board elections will happen, email the conference organizer or the
NAFE Executive Director , respectively. If you enjoyed a weekend “Not FE” message, then contact and thank
the individual sender, rather than sending “Thanks” to the entire NAFE-L list.
h. “Not FE” messages are permitted on Saturdays and Sundays only . NAFE-L participants have diverse
personal interests (e.g., marathon running, salmon fishing, ballroom dancing, movies, and more) and have long
been known for wisdom and wit. In the spirit of generosity and community that imbues NAFE-L and to promote
the collegiality that strengthens professional discussions, “Not FE” messages and associated replies/threads
are permitted on Saturdays and Sundays. Such messages must have a subject line beginning with “Not FE:”
followed by some description of the message’s contents. For example, “Not FE: Humor for the weekend” or
“Not FE: Recommending the movie ‘Searching’ available on Prime” or “Not FE: Sharing new UChicago study
on auto industry.” Phrases such as “Quasi FE” or “Almost FE” or “FE?” are not valid subject lines.
i. The subscriber’s full name must appear as the “Sender” and at least the first name must appear at
the end of the message. NAFE-L subscribers are accountable for the content they post. If your email program
is configured to send emails from a business’ name, rather than from you individually, please change your
settings or use a different email address unique to you.
j. Full auto-signatures are optional. Many email programs permit the user to quickly select and delete full
auto-signatures (name, address, phone/fax, privacy statements, logos, etc.) from a message before hitting
“send.” New subscribers or those who send NAFE-L messages very infrequently might want to include such
identifying information, but for those subscribers who are likely well-known to NAFE-L users due to their
frequent participation, they should sign briefly, even with only a first name since their full name will be shown
as the sender. This helps participants read a thread more quickly and also helps reduce the archive volume.
k. Sharing data and articles is an important feature of NAFE-L. Active internet links are preferred over
attachments, but NAFE-L does accept PDF attachments. Using hyperlinks within the body of your message is
encouraged, but please check to ensure the link works. (If the link is broken, notify the individual, not the entire
list.) Links to articles that are behind a paywall (e.g., Wall Street Journal articles) are accepted, and users can
then determine whether or not they want to pay to access the information.
l. As financial professionals, we take copyright protections seriously. Posting any copyrighted material,
including articles from NAFE’s Journal of Forensic Economics , is prohibited. “Fair use” guidelines that apply in
the classroom often do not apply in business forums such as NAFE-L. The burden of determining relevant
copyright restrictions resides with the initial message’s author.
m. When subscribers fail to abide by the TOS, you can be assured they are being contacted privately,
off-NAFE-L, by the NAFE-L Managers. Often, the violation is a simple mistake and not repeated. New
subscribers in particular are provided some leeway as they adapt to the TOS. But accumulated or flagrant
violations risk suspension from NAFE-L, temporary or permanent.
GENERAL PRACTICES REGARDING USE AND STORAGE
You acknowledge that the Owner may establish general practices and limits concerning use of the Service,
including without limitation the maximum number of days that email messages or other uploaded content will
be retained by the Service, the maximum number of email messages that may be sent from or received by an
account on the Service, and the maximum size of any email message that may be sent from or received by an
account on the Service. Although every attempt is made to preserve NAFE-L postings, you agree that the
Owner has no responsibility or liability for the deletion or failure to store any messages and other
communications or other content maintained or transmitted by the Service. You acknowledge that the Owner
reserves the right to delete accounts that are inactive for an extended period of time. You further acknowledge
that the Owner reserves the right to change these general practices and limits at any time, in its sole discretion,
with or without notice.
MODIFICATIONS TO SERVICE
The Owner reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or
any part thereof) with or without prior notice. You agree that the Owner shall not be liable to you or to any third
party for any modification, suspension, or discontinuance of the Service.
TERMINATION
You agree that the Owner, in its sole discretion, may suspend or terminate your use of the Service, and
remove and discard any content within the Service, for any reason, including, without limitation, failure to
maintain valid NAFE membership, lack of use, or if the Owner believes that you have violated or acted
inconsistently with the letter or spirit of the TOS. The Owner may also in its sole discretion and at any time
discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of
your access to the Service under any provision of this TOS may be effected without prior notice, and
acknowledge and agree that the Owner may immediately bar any further access to the Service. Further, you
agree that the Owner shall not be liable to you or any third-party for any termination of your access to the
Service.
DISCLAIMER OF WARRANTIES AS SET BY THE OWNER OF THE NAFE-L
By being a subscriber and user of the NAFE-L email list, you expressly understand and agree that:
a. Your use of the Service is at your sole risk. The Service is provided on an “as is” basis and “as available”
basis. NAFE expressly disclaims all warranties of any kind, whether express or implied, including, but not
limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
b. NAFE makes no warranty that: (a) the Service will meet your requirements; (b) the Service will be
uninterrupted, timely, secure, or error-free; (c) the results that may be obtained from the use of the Service will
be accurate or reliable; (d) the quality of any products, services, information, or other material purchased or
obtained by you through the Service will meet your expectations; or (e) any errors in the software will be
corrected.
c. Any material downloaded or otherwise obtained through the use of the Service is done at your own
discretion and risk and you will be solely responsible for any damage to your computer system or loss of data
that results from the download of such material.
